This website and the related online services through which products are offered or sold (collectively, the "Services") are owned and operated by BBSF INC. d/b/a Bon Pharm ("Bon Pharm," "Company," "we," "us," or "our"). Your use of the Services is subject to these Terms. When you place an order or enroll in a subscription, you will also be required to affirmatively agree to the applicable purchase and subscription terms presented to you at or before checkout. You must be at least 18 years old and legally capable of entering into a binding agreement to purchase products through the Services or enroll in a subscription or auto-ship program.

PLEASE READ THESE TERMS CAREFULLY BEFORE USING ANY SERVICES

These Terms govern your access to and use of the Services and, where applicable, your purchase of products from Bon Pharm. Additional terms may apply to particular features, promotions, subscriptions, auto-ship programs, or other offers. Any additional terms will be presented in connection with the applicable offer. If additional terms conflict with these Terms, the additional terms will control only with respect to the specific feature or transaction to which they apply, except where applicable law requires otherwise.

Commercial Transactions

To purchase products through the Services, you must: (a) be at least 18 years old and legally capable of entering into the transaction; (b) provide complete and accurate order, billing, shipping, and payment information; (c) use a payment method that you are authorized to use; and (d) authorize Bon Pharm and its payment service providers to charge the amounts disclosed to you at checkout, including applicable product charges, taxes, shipping charges, and any recurring subscription charges to which you affirmatively consent.

Order Acceptance

An order confirmation confirms that we have received your order request; it does not necessarily mean that we have accepted the order. To the extent permitted by applicable law, we may refuse or cancel an order before shipment because of product unavailability, an obvious pricing or description error, suspected fraud or unauthorized payment activity, shipping restrictions, legal or regulatory restrictions, or another legitimate reason. If we cancel an order after payment has been collected, we will refund the amount charged for the canceled portion of the order.

Returns and refunds are governed by our Refund and Return Policy, which is incorporated into these Terms by reference. Nothing in these Terms or our Refund and Return Policy limits any right or remedy that cannot lawfully be waived. After the applicable voluntary return period has expired, we generally do not accept voluntary returns or issue voluntary refunds, except as otherwise stated in our Refund and Return Policy or required by applicable law.

We make reasonable efforts to provide accurate and current product information. Website content may occasionally contain typographical, technical, pricing, availability, or other errors. If we discover a material error affecting an order before shipment, we may notify you, correct the error, and, where appropriate, provide you with an opportunity to cancel the affected order.

Bon Pharm dietary supplements are not intended to diagnose, treat, cure, or prevent any disease. If you believe a product materially differs from the product description, please contact Bon Pharm Customer Service. The matter will be handled in accordance with our Refund and Return Policy and any rights or remedies available under applicable law. If an obvious pricing error is discovered before shipment, we may notify you of the correct price and ask whether you wish to proceed, or we may cancel the affected order and refund any amount already charged for that order.

Unless Bon Pharm expressly authorizes otherwise in writing, products purchased through the Services are intended for personal or household use and not for unauthorized commercial resale. To the extent permitted by applicable law, Bon Pharm may limit quantities, reject orders, or suspend accounts where reasonably necessary to address suspected fraud, unauthorized resale, abuse of promotions, payment disputes, security threats, or other misuse of the Services.

Subscriptions and Auto-Ship

Subscription Frequency. If you enroll in a Bon Pharm subscription or auto-ship program, eligible subscription products will be scheduled for shipment approximately every 30 days in accordance with the subscription offer presented to you at enrollment.

Initial Three-Month Commitment. The subscription includes an initial minimum commitment of three consecutive monthly subscription orders. This minimum purchase obligation will be clearly disclosed before you enroll.

Subscription Discount. Subscription orders may be offered at a discounted subscription price. The price applicable to your subscription will be clearly disclosed before enrollment and at checkout.

Automatic Continuation After Initial Commitment. After completion of the initial three-month commitment, the subscription will continue approximately every 30 days and your selected payment method will be charged for each recurring subscription order unless and until you cancel.

Authorization. By affirmatively enrolling in the subscription, you authorize Bon Pharm and its payment service providers to charge your selected payment method for the initial three monthly orders and, after completion of the initial commitment, for recurring approximately 30-day subscription orders until you cancel.

Cancellation During the Initial Commitment. You may submit a request to stop automatic renewal at any time. If you submit the request before completion of the three-month minimum commitment, the subscription will not renew beyond the initial three-order commitment, but the cancellation request does not eliminate the minimum purchase obligation that you accepted at enrollment, except to the extent otherwise required by applicable law.

Cancellation After the Initial Commitment. After completion of the initial three-month commitment, you may cancel future subscription renewals at any time using the cancellation method made available by Bon Pharm.

Orders Already in Processing. Cancellation does not cancel an order that has already entered processing before the cancellation became effective. Any return or refund for an order already processed or shipped is governed by the Refund and Return Policy and applicable law.

Price Changes. If Bon Pharm changes the recurring subscription price, Bon Pharm will provide any advance notice required by applicable law before the new price takes effect.

Required Notices. Bon Pharm will provide subscription acknowledgments, renewal-related notices, price-change notices, promotional-price notices, and other notices when required by applicable law.

Your License to Access and Use the Services and Ownership

The content, information, software, designs, materials, functions and data included in and contained on the Services (the "Content") are protected by intellectual property and other laws. You must comply with these and any other applicable laws when you use the Services. Unless indicated to the contrary and subject to your strict compliance with these Terms, you may access and use the Services only for personal, non-commercial use, or in connection with your authorized purchase or personal use of products offered through the Services.

In connection with these uses, Bon Pharm grants you a limited, non-exclusive, revocable, non-assignable, personal and non-transferable license to access, copy, download, display, view, use, play and/or print one (1) copy of the Content made available on the Services on a personal computer, mobile phone or other Internet-enabled device, provided that you: (a) keep intact all copyright and other proprietary notices; (b) make no modifications to the Content; and (c) do not use the Content in a manner that suggests an association with any of our products, services, or brands.

Any business use, "re-mailing," or high-volume or automated use of the Services is prohibited. We reserve all rights in the Content and the Services that we do not specifically grant in these Terms.

    Prohibited Uses

    Without limitation, you may not modify, distribute, transmit, perform, broadcast, publish, license, reverse engineer, transfer or sell, or create derivative works from, the Services or any Content unless you obtain our prior written approval. You also may not use the Services in a way that could harm us or any third party. For example, you may not use the Services in a way that could:

    • Dmage or interfere with the proper working of the Services;
    • Intercept any Content or information that we have not intentionally made available to you or defeat any access controls that we have implemented;
    • Give you access to the Services or Content using any interface other than the interface that we provide;
    • Frame the Services, display any Content in connection with an unauthorized logo or mark;
    • Make, attribute to Bon Pharm, or disseminate through the Services any unauthorized, false, misleading, or unlawful health-related claim concerning a Bon Pharm product, including any statement that a dietary supplement diagnoses, treats, mitigates, cures, or prevents a disease;
    • Violate applicable local, state, federal, and international laws or regulations;
    • Transmit, or facilitate the sending of, any advertising or promotional material without our prior Company written consent.

    In addition to our other legal rights, we may limit or terminate your license to use the Services, or certain features of the Services, at any time and for any reason, without prior notice to you including our belief you violated these Terms.

    Registration and Access Restrictions

    You may be required to register for an account with us in order to use certain features of the Services. You agree to: (a) provide true, accurate, current and complete information about yourself when we request it; (b) maintain and promptly update this information; (c) use limited-access portions of the Services only using access credentials that we have issued to you; and (d) exit your account at the end of each session. You must maintain the confidentiality of any access credentials that we issue to you and may not share them with any other person.

    No Medical Advice

    The information provided through the Services is for general informational purposes and is not medical advice and is not intended as a substitute for professional medical advice, diagnosis, or treatment. Always read and follow the directions, warnings, and other information appearing on the applicable product label. If you have a medical condition, take prescription or other medications, are pregnant or nursing, are planning surgery, or have questions concerning whether a dietary supplement is appropriate for you, consult a qualified healthcare professional before using the product. Do not disregard professional medical advice or delay seeking it because of information obtained through the Services. Bon Pharm dietary supplements are not intended to diagnose, treat, cure, or prevent any disease.

    Product Use

    You are responsible for reading and following the directions, warnings, serving instructions, storage instructions, and other information appearing on the product label. Do not use a product in a manner inconsistent with its label or applicable professional medical advice. Product results may vary among individuals. No statement regarding a customer's individual experience should be understood as a guarantee that another customer will experience the same result.

    Privacy

    Our Privacy Policy describes how Bon Pharm collects, uses, discloses, and otherwise processes personal information in connection with the Services. Please review the Privacy Policy for additional information concerning our data practices.

    User Submissions

    By submitting User Submissions through the Services, you grant Bon Pharm a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, publish, format, and otherwise use the User Submission as reasonably necessary to operate, administer, promote, and improve the Services and Bon Pharm's products, subject to applicable law and our Privacy Policy. You represent that you have the rights and permissions necessary to grant this license. By providing User Submissions, you represent that they:

    • Will be original with you or you have all necessary rights from third parties;
    • Will not include medical or other professional advice;
    • Will not be false, fraudulent, libelous, defamatory, sexually explicit, obscene, threatening, invasive of privacy or publicity rights;
    • Will not contain software viruses or malicious code.

    Product Reviews and Testimonials

    If you submit a product review, testimonial, or other statement about a Bon Pharm product, you agree that the submission will reflect your genuine experience and opinions and will not contain information that you know to be false or misleading. You may not submit a review on behalf of another person or falsely represent your identity, experience, or relationship with Bon Pharm. If you received compensation, a free product, discount, or another material benefit in connection with a review or testimonial, you must disclose that relationship where required by applicable law.

    Bon Pharm may moderate or remove User Submissions in accordance with applicable law and its content-moderation practices, but is not obligated to publish every submission. Bon Pharm reserves the right, but not the obligation, to remove or restrict access to User Submissions that Bon Pharm reasonably believes violate these Terms, applicable law, intellectual-property rights, privacy or publicity rights, or applicable product-claims standards.

    Links to Third Party Sites

    The Services may contain links to websites or services operated by third parties. Unless expressly stated otherwise, Bon Pharm does not control those third-party websites or services. Your use of a third-party website or service is subject to the terms and privacy practices of the applicable third party.

    Coupons

    Coupons, promotional codes, discounts, and promotional offers are subject to any eligibility requirements, expiration dates, exclusions, product restrictions, subscription restrictions, and other terms disclosed with the applicable offer. Unless expressly permitted, promotional offers may not be reproduced, resold, transferred, or used fraudulently. Bon Pharm may modify or discontinue a promotion prospectively, subject to applicable law and the terms disclosed for purchases already completed.

    International Orders

    Bon Pharm may make certain products available for shipment to selected destinations outside the United States in the future. International shipping availability, eligible products, shipping methods, and charges will be displayed at checkout where applicable. Unless Bon Pharm expressly states otherwise for a particular shipment, the recipient may be responsible for complying with destination-country requirements applicable to the purchaser, recipient, or importer, including applicable customs, import, tax, and product restrictions.

    Bon Pharm does not represent that every product offered in the United States may lawfully be imported, distributed, or used in every other country. Unless expressly collected by Bon Pharm at checkout, the recipient may be responsible for applicable import duties, taxes, customs charges, brokerage fees, or similar charges. Nothing in this section eliminates any obligation of Bon Pharm that cannot lawfully be transferred to the customer.

    TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BON PHARM AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATING TO THE SERVICES, TO THE EXTENT SUCH DAMAGES MAY LAWFULLY BE EXCLUDED.

    NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY, WARRANTIES, RIGHTS, OR REMEDIES THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

    Some jurisdictions do not allow certain exclusions or limitations of liability. In those jurisdictions, the foregoing limitations apply only to the maximum extent permitted by applicable law.

    Indemnification

    To the extent permitted by applicable law, you agree to indemnify and hold harmless Bon Pharm and its officers, directors, employees, and agents from third-party claims, liabilities, losses, and reasonable costs arising directly from: (a) your material violation of these Terms; (b) your unlawful, fraudulent, or intentionally harmful use of the Services; or (c) a User Submission provided by you that infringes or misappropriates a third party's intellectual-property, privacy, or publicity rights. This provision does not require you to indemnify Bon Pharm for claims arising solely from ordinary lawful use of a Bon Pharm product in accordance with its directions.

    Governing Law

    These Terms and any dispute arising out of or relating to these Terms, the Services, or a purchase from Bon Pharm will be governed by the laws of the State of California, without regard to its conflict-of-laws principles, except to the extent that federal law applies or the mandatory consumer-protection laws of another jurisdiction apply and cannot lawfully be waived.

    Forum and Venue

    Subject to any right that cannot lawfully be waived, any judicial action or proceeding arising out of or relating to these Terms, the Services, or a purchase from Bon Pharm shall be brought in the state courts located in Los Angeles County, California or, where federal subject-matter jurisdiction exists, in the United States District Court for the Central District of California. Each party consents to the personal jurisdiction of those courts. Nothing in this section prevents a consumer from pursuing a claim in another forum if applicable law gives the consumer a non-waivable right to do so.

    Changes to These Terms

    We may update these Terms from time to time. The updated Terms will be posted on the Services with an updated effective date. Material changes will be communicated when required by applicable law. Changes will apply prospectively unless applicable law permits otherwise. Material changes affecting an existing subscription, including changes to recurring charges or other material subscription terms, will be subject to the notices and other procedures required by applicable law.

    Entire Agreement

    These Terms, together with the Privacy Policy, Refund and Return Policy, Shipping Policy, and any additional subscription, promotion, or offer-specific terms expressly incorporated into the applicable transaction, constitute the agreement between you and Bon Pharm concerning the subject matter addressed by those documents.

    Severability

    If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or, if it cannot be so enforced, severed from these Terms, and the remaining provisions will remain in effect.

    Electronic Communications

    When you transact with Bon Pharm electronically, you consent to receive transaction-related notices and records electronically, including order confirmations, shipping notices, subscription acknowledgments, and legally required subscription notices, at the electronic contact information you provide, subject to applicable law.

    Consent to receive transactional communications does not by itself constitute consent to receive marketing text messages.
